These Terms of Service ("Terms") govern your access to and use of the Stereotyped platform, website at stereotyped.ai, and related services (collectively, the "Services") provided by Stereotyped Pty Ltd ("Stereotyped", "we", "us", or "our").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

1. Services

Stereotyped provides AI-powered sizing intelligence software for fashion brands. Our Services include a sizing recommendation widget, analytics dashboard, brand integration tools, and related support. The specific features available to you depend on the subscription plan you have agreed to.

2. Eligibility

You must be at least 18 years old and have the authority to enter into a binding agreement on behalf of your business to use our Services. By using the Services, you represent and warrant that you meet these requirements.

3. Account Registration and Access

To access our Services, you may be required to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use at support@stereotyped.ai.

We reserve the right to suspend or terminate accounts that violate these Terms or where we reasonably suspect fraudulent or harmful activity.

Access to the Stereotyped platform is provided on a subscription basis. Fees are as outlined in your agreed proposal or on our pricing page. Unless otherwise stated:

All intellectual property in the Stereotyped platform, including software, algorithms, design, trademarks, and content, is owned by Stereotyped Pty Ltd or its licensors. Nothing in these Terms transfers ownership of any intellectual property to you.

You retain ownership of your brand data and content. By using our Services, you grant us a limited licence to process your data solely for the purpose of providing the Services.

Our collection and use of personal information is governed by our Privacy Policy and Data Processing Agreement, which form part of these Terms. By using the Services, you agree to those documents.

8. Third-Party Integrations

Our Services may integrate with third-party platforms (including Shopify and other e-commerce providers). We are not responsible for the availability, accuracy, or terms of those third-party services. Your use of integrated third-party services is subject to their own terms and conditions.

9. Disclaimers

To the extent permitted by law, the Services are provided "as is" without warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, or produce any particular commercial outcome, including specific conversion rates or return reductions. Results shown on our website reflect historical client data and are not guaranteed.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Stereotyped's total liability to you for any claim arising out of or relating to these Terms or the Services will not exceed the total fees paid by you to Stereotyped in the three months preceding the claim. We will not be liable for any indirect, incidental, consequential, or punitive damages.

Nothing in these Terms excludes liability that cannot be excluded under the Australian Consumer Law, including non-excludable consumer guarantees.

11. Termination

Either party may terminate the subscription with 30 days' written notice. We may terminate immediately if you breach these Terms. Upon termination, your access to the Services will cease and we will handle your data in accordance with our Privacy Policy and Data Processing Agreement.

12. Governing Law

These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland, Australia.

13. Changes to These Terms

We may update these Terms from time to time. We will provide reasonable notice of material changes. Continued use of the Services after the effective date of changes constitutes acceptance.
